E\u011fitim-Bir-Sen taraf\u0131ndan haz\u0131rlanan \u201c\u00dcniversite \u0130dari Personelinin \u00d6zl\u00fck Haklar\u0131 Sorunlar ve \u00c7\u00f6z\u00fcm \u00d6neriler\u201d ba\u015fl\u0131kl\u0131 rapor ya\u015fanan sorunlar\u0131 derli toplu olarak ortaya koymu\u015ftur. Bu yaz\u0131m\u0131zda haz\u0131rlanan rapor \u00f6zelinde konuyu a\u00e7\u0131klamaya \u00e7al\u0131\u015faca\u011f\u0131z.<\/p>\n<p style=\"text-align:justify\"><strong>Ayn\u0131 i\u015fi yapan personele kurumlara g\u00f6re farkl\u0131 \u00f6demeler yap\u0131l\u0131yor<\/strong><\/p>\n<p style=\"text-align:justify\">Ayn\u0131 i\u015fi yapan kamu g\u00f6revlilerinin, ayn\u0131 s\u0131n\u0131fta olmas\u0131na ra\u011fmen, farkl\u0131 kurumlarda farkl\u0131 mali ve sosyal imk\u00e2nlardan yararland\u0131r\u0131lmas\u0131 s\u00f6z konusudur. Di\u011fer yandan, akademik, askeri personel ve h\u00e2kim\/savc\u0131lar\u0131n ekonomik ve sosyal kazan\u0131mlar\u0131n\u0131n ayn\u0131 kurum i\u00e7erisindeki di\u011fer personellerden farkl\u0131 olmas\u0131, kurum i\u00e7erisinde s\u0131k\u0131nt\u0131lar \u00fcretmektedir. Bu noktada \u00fcniversitelerde \u00e7al\u0131\u015fan idari personel, farkl\u0131 t\u00fcrde personeli beraber \u00e7al\u0131\u015ft\u0131ran bir kurum olarak \u00fcniversitelerin kamu personel rejimi i\u00e7indeki konumundan kaynakl\u0131 olarak sorun ya\u015famaktad\u0131rlar<\/p>\n<p style=\"text-align:justify\"><strong>Kurum i\u00e7i y\u00fckselme ve kariyer ilerlemesi s\u00fcrecinde sorunlar ya\u015fan\u0131yor<\/strong><\/p>\n<p style=\"text-align:justify\">\u0130dari personel, kurum i\u00e7i y\u00fckselme ve kariyer ilerlemesi s\u00fcrecinin i\u015flemedi\u011fini g\u00f6rmektedirler. Ayr\u0131ca daha fazla \u00e7al\u0131\u015fmalar\u0131 durumunda kar\u015f\u0131l\u0131\u011f\u0131n\u0131 alamayacaklar\u0131n\u0131, kendilerine sa\u011flanan sosyal imk\u00e2nlar\u0131n yeterli olmad\u0131\u011f\u0131, \u00e7al\u0131\u015fma ko\u015fullar\u0131n\u0131n kendilerini ve emeklerini yeterince ortaya koymalar\u0131n\u0131 engelledi\u011fini d\u00fc\u015f\u00fcnmektedirler. Bunun yan\u0131nda \u00f6d\u00fcllendirme ve g\u00fcd\u00fclenmenin performanslar\u0131n\u0131 etkileyerek i\u015f kalitesini art\u0131raca\u011f\u0131n\u0131 bildikleri halde \u00fcniversite y\u00f6netimlerinin bu konuda isteksiz, umursamaz ve tutars\u0131z olduklar\u0131na inanmaktad\u0131rlar. \u0130dari personelin, ki\u015fisel geli\u015fimlerini art\u0131rma ve potansiyellerini a\u00e7\u0131\u011fa \u00e7\u0131karma noktas\u0131nda kurumdan destek beklediklerini s\u00f6ylemek do\u011fru olacakt\u0131r.<\/p>\n<p style=\"text-align:justify\"><strong>\u00dcniversitelerdeki idari personelin di\u011fer kurumlara g\u00f6re \u00fccretleri daha d\u00fc\u015f\u00fck<\/strong><\/p>\n<p style=\"text-align:justify\">T\u00fcrkiye\u2019deki memurlar\u0131n ya\u015fad\u0131\u011f\u0131 genel \u00fccret sorununun yan\u0131nda \u00fcniversitede \u00e7al\u0131\u015fan idari personelin kamu \u00e7al\u0131\u015fanlar\u0131n\u0131n i\u00e7inde \u00fccret skalas\u0131n\u0131n en alt\u0131nda bulunan kamu personeli oldu\u011fu g\u00f6r\u00fclmektedir. \u0130dari personel, e\u011fitim durumu, kadro ve pozisyonlar\u0131, yetenek ve tecr\u00fcbesiyle orant\u0131l\u0131 bir \u00fccret alamamakta; y\u00fcksek\u00f6\u011fretim tazminat\u0131, geli\u015ftirme \u00f6dene\u011fi, d\u00f6ner sermaye katk\u0131 pay\u0131 gibi \u00fcniversitelere \u00f6zg\u00fc \u00fccret kalemlerinden de mahrum b\u0131rak\u0131lmaktad\u0131r.<\/p>\n<p style=\"text-align:justify\"><strong>G\u00f6revde y\u00fckselmelerde sorunlar ya\u015fan\u0131yor<\/strong><\/p>\n<p style=\"text-align:justify\">Y\u00fcksek\u00f6\u011fretim \u00dcst Kurulu\u015flar\u0131 ile Y\u00fcksek\u00f6\u011fretim Kurumlar\u0131 Personeli G\u00f6revde Y\u00fckselme ve Unvan De\u011fi\u015fikli\u011fi Y\u00f6netmeli\u011fi\u2019nin 17. maddesinde bo\u015f kadro durumu ve talepler g\u00f6z \u00f6n\u00fcne al\u0131narak, her unvan i\u00e7in ayr\u0131 ayr\u0131 ve y\u0131lda iki defadan fazla olmamak \u00fczere g\u00f6revde y\u00fckselme s\u0131nav\u0131 yap\u0131labilece\u011fi h\u00fck\u00fcm alt\u0131na al\u0131nm\u0131\u015ft\u0131r. \u00dcniversitelerde \u00e7al\u0131\u015fan idari personel, g\u00f6revde y\u00fckselme s\u0131navlar\u0131n\u0131n \u00e7ok seyrek aral\u0131klarla yap\u0131l\u0131yor olmas\u0131ndan dolay\u0131 s\u0131k\u0131nt\u0131 \u00e7ekmektedirler. G\u00f6revde y\u00fckselme ve unvan de\u011fi\u015fikli\u011fi s\u00fcrecinin i\u015fletilmiyor olu\u015fu, idari personelin bir ba\u015fka kuruma ge\u00e7i\u015fine de \u00e7o\u011fu zaman muvafakat verilmedi\u011fi unsuruyla birlikte de\u011ferlendirildi\u011finde, \u00fcniversite idari personelinin mesleki ilerleme ve kariyer yapma imk\u00e2nlar\u0131n\u0131 fiilen ortadan kald\u0131rmaktad\u0131r.<\/p>\n<p style=\"text-align:justify\"><strong>Yer de\u011fi\u015fikli\u011finde ciddi sorunlar ya\u015fan\u0131yor<\/strong><\/p>\n<p style=\"text-align:justify\">657 say\u0131l\u0131 Kanuna tabi olarak istihdam edilen \u00fcniversite idari personeli, kadro ve pozisyon unvanlar\u0131 itibariyle her bir \u00fcniversitede ayn\u0131 yeterlili\u011fe sahip olarak ayn\u0131 i\u015fi yapmalar\u0131na ra\u011fmen bakanl\u0131k ve ta\u015fra te\u015fkilat\u0131 bulunan di\u011fer merkezi kamu kurum ve kurulu\u015flar\u0131nda \u00e7al\u0131\u015fan idari personelin iller aras\u0131nda\/ kurumlar aras\u0131nda yer de\u011fi\u015fikli\u011fine benzer bir merkez\u00ee yer de\u011fi\u015fikli\u011fi hakk\u0131nda sahip de\u011fillerdir.<\/p>\n<p style=\"text-align:justify\">\u00dcniversite idari personelinin bir di\u011fer \u00fcniversiteye yer de\u011fi\u015fikli\u011fi yapabilmesi, kadrosunun bulundu\u011fu \u00fcniversitenin muvafakatine ba\u011fl\u0131d\u0131r. Bu muvafakatin verilmemesi uzun dava s\u00fcre\u00e7lerine neden olmakta; \u00e7o\u011fu durumda yer de\u011fi\u015fikli\u011fi yap\u0131lmak istenen \u00fcniversite de personel ihtiyac\u0131 i\u00e7in beklemek zorunda olmad\u0131\u011f\u0131 i\u00e7in lehe sonu\u00e7lanan muvafakat davalar\u0131 dahi sonu\u00e7 do\u011furamamaktad\u0131r.<\/p>\n<p style=\"text-align:justify\">H\u00e2lihaz\u0131rda \u00e7o\u011fu \u00fcniversite, di\u011fer \u00fcniversitelere yer de\u011fi\u015fikli\u011fi yapmak isteyen idari personelinin bu taleplerini y\u00f6nergeler arac\u0131l\u0131\u011f\u0131yla d\u00fczenlemektedir. Bu y\u00f6nergelerde, yer de\u011fi\u015fikli\u011fi yapmak isteyen idari personel i\u00e7in asgari g\u00f6rev yapma s\u00fcresi, kadro unvan\u0131\/ hizmet s\u0131n\u0131f\u0131 baz\u0131nda kontenjan, ge\u00e7erli mazeret vb. \u015fartlar aranmaktad\u0131r. Ancak bu y\u00f6nergelerin yeksenak olmad\u0131\u011f\u0131 ve uygulama birli\u011fi sa\u011flanamad\u0131\u011f\u0131 gibi di\u011fer \u00fcniversiteleri ba\u011flay\u0131c\u0131 h\u00fck\u00fcmler tesis edemedi\u011fi a\u00e7\u0131kt\u0131r.<\/p>\n<p style=\"text-align:justify\"><strong>\u0130dari personeller g\u00f6revlendirmelerde mobbinge maruz kal\u0131yor<\/strong><\/p>\n<p style=\"text-align:justify\">Mobbing kavram\u0131n\u0131n \u00fclkemizde literat\u00fcre girmesinde \u00fcniversitelerdeki hukuka ayk\u0131r\u0131 uygulamalar\u0131n ba\u015fat rol oynad\u0131\u011f\u0131n\u0131 \u00fcz\u00fcnt\u00fcyle g\u00f6rmekteyiz. Bu ba\u011flamda 2547 say\u0131l\u0131 Kanun\u2019un 13\/b-4 maddesinin amac\u0131 d\u0131\u015f\u0131nda \u00fcniversite y\u00f6netimince bir mobbing arac\u0131 olarak s\u0131kl\u0131kla kullan\u0131ld\u0131\u011f\u0131 bilinmektedir. S\u0131n\u0131rlar\u0131 \u00e7izilmemi\u015f atama ve g\u00f6revlendirmeye dair yetkilerin suiistimal edilerek bir bask\u0131, s\u00fcrg\u00fcn, mobbing, hukuksuzluk, sendikal ayr\u0131mc\u0131l\u0131k arac\u0131 olarak kullan\u0131lmas\u0131 \u00fcniversitelerde yayg\u0131n bir sorundur.<\/p>\n<p style=\"text-align:justify\"><strong>Ek g\u00f6sterge ve makam tazminat\u0131 uygulamas\u0131nda dengesizlik var<\/strong><\/p>\n<p style=\"text-align:justify\">Daire ba\u015fkanlar\u0131n\u0131n ek g\u00f6stergeleri 4200 olmas\u0131na ra\u011fmen genel sekreter yard\u0131mc\u0131lar\u0131 ile daire ba\u015fkan\u0131na denk olan fak\u00fclte sekreterlerinin ek g\u00f6stergelerinin 3600 olmas\u0131 hak kayb\u0131na ve hiyerar\u015fik bozulmaya neden olmaktad\u0131r. Y\u00fcksek\u00f6\u011fretim kurumlar\u0131nda g\u00f6revli Genel Sekreter Yard\u0131mc\u0131lar\u0131, Fak\u00fclte Sekreterleri, Enstit\u00fc sekreterleri ve Y\u00fcksekokul sekreterlerinin ek g\u00f6stergelerinin art\u0131r\u0131lmas\u0131 noktas\u0131nda d\u00fczenleme yap\u0131lmal\u0131d\u0131r. Bakanl\u0131k daire ba\u015fkanlar\u0131na 2000 g\u00f6sterge rakam\u0131 \u00fczerinden makam tazminat\u0131 \u00f6denmekteyken \u00fcniversite daire ba\u015fkanlar\u0131 bu haktan yararlanmamaktad\u0131r. \u00dcniversite daire ba\u015fkanlar\u0131 da bakanl\u0131klarda g\u00f6rev yapan daire ba\u015fkanlar\u0131n\u0131n yararland\u0131\u011f\u0131 tazminatlardan ayn\u0131 \u015fekilde yararlanmal\u0131d\u0131r.<\/p>\n<p style=\"text-align:justify\">Y\u00f6netim ve temsil makam\u0131 olmalar\u0131na ra\u011fmen y\u00fcksek\u00f6\u011fretim kurumlar\u0131nda g\u00f6revli daire ba\u015fkan\u0131, fak\u00fclte sekreteri, y\u00fcksekokul sekreteri ve \u015fube m\u00fcd\u00fcrlerine makam tazminat\u0131 \u00f6denmemesi ma\u011fduriyete neden olmaktad\u0131r. 657 say\u0131l\u0131 Devlet Memurlar\u0131 Kanunu\u2019na IV Say\u0131l\u0131 Makam Tazminat\u0131 y\u00fcksek\u00f6\u011fretim kurumlar\u0131nda g\u00f6revli daire ba\u015fkan\u0131, fak\u00fclte sekreteri, y\u00fcksekokul sekreteri ve \u015fube m\u00fcd\u00fcrlerinin eklenerek s\u00f6z konusu kadro unvanlar\u0131 i\u00e7in 2000 g\u00f6sterge rakam\u0131n\u0131n alt\u0131nda olmamak \u00fczere makam tazminat\u0131 \u00f6denmesi sa\u011flanmal\u0131d\u0131r.<\/p>\n<p style=\"text-align:justify\"><strong>\u00c7al\u0131\u015f\u0131lan s\u00fcreler kazan\u0131lm\u0131\u015f hak ayl\u0131k derecesinde dikkate al\u0131nm\u0131yor<\/strong><\/p>\n<p style=\"text-align:justify\">\u0130\u015f\u00e7ilikten s\u00f6zle\u015fmelili\u011fe, akabinde memurlu\u011fa ge\u00e7en personelin, b\u00fct\u00fcn hizmeti ayn\u0131 kamu kurumunda ayn\u0131 i\u015fi yaparak ge\u00e7mesine ra\u011fmen, i\u015f\u00e7ilikte ge\u00e7irilen s\u00fcreler memuriyete ve memur emeklili\u011fine esas hizmet s\u00fcresinden say\u0131lmamas\u0131 hak kay\u0131plar\u0131na neden olmaktad\u0131r.
